AmpolCard with EV Charging Terms & Conditions
1. Acceptance of EV Charging Application
1.1 Ampol may accept or decline an EV Charging Application at its sole discretion by written notice to you.
1.2 You agree to be bound by these EV Charging Conditions which operate to add the EV Charging Product as a new product type under your current contractual framework with Ampol which allows you to purchase products and services on credit using the AmpolCard Facility (AmpolCard Framework). These EV Charging Conditions, together with your existing AmpolCard Framework, allow you to use the AmpolCard Facility for the purchase of EV Charging Products.
1.3 If Ampol accepts your EV Charging Application, Ampol will issue new EV Enabled Cards to you for use by the Cardholders nominated in your EV Charging Application.
2. Term
2.1 These EV Charging Conditions commence when Ampol accepts your EV Charging Application and continue until terminated in accordance with clause 10.
3. Credit Limit
3.1 Any credit limit currently applicable to you under your existing AmpolCard Framework continues to apply and any purchases using EV Enabled Cards will be subject to such credit limit.
4. Payments and Reports
4.1 Purchases using EV Enabled Cards are subject to the same payment terms that are applicable to you for purchases of products or services using the AmpolCard Facility under your existing AmpolCard Framework.
4.2 Ampol will continue to provide you with consolidated tax invoices and transaction data in accordance with your existing AmpolCard Framework. Once you receive your new EV Enabled Cards, your tax invoices and transaction data will capture any purchases made using such cards. EV Charging Transaction data will appear on your tax invoices as “adjustments, fees and other charges”.
5. Receipts
5.1 No point-of-sale dockets or receipts will be issued to Cardholders for purchases of EV Charging Products.
6. Discounted Pricing for EV Charging Products
6.1 The price for EV Charging Products is the advertised price for electric vehicle charging across the public AmpCharge Network less a cents per kWh discount as agreed in advance between you and Ampol in writing (EV Charging Discount).
6.2 Ampol may at its sole discretion revoke or vary the EV Charging Discount by giving you no less than 30 days’ written notice.
7. Daily purchase limit
7.1 EV Charging Transactions are subject to a daily purchase limit set by Ampol in its discretion. The total value of EV Charging Transactions which may be made on a single EV Enabled Card is subject to a default daily limit of $100 per 24-hour period, resetting at 2AM AEDT each day (Daily EV Charging Limit).
7.2 You may request that Ampol vary the Daily EV Charging Limit. Ampol may approve or reject such a request in its absolute discretion.
8. Availability of EV Charging Products
8.1 You acknowledge that EV Charging Products are not available at all Ampol branded sites but are only available at participating sites across the AmpCharge Network.
8.2 Ampol does not make any warranties or guarantees regarding the uptime, performance, availability or reliability of electric vehicle charging points on the AmpCharge Network.
9. Risk
9.1 Risk in the EV Charging Products will pass to the Cardholder when the EV Charging Product has passed into the Cardholder’s Electric Vehicle.
10. Termination
10.1 If your right to use the AmpolCard Facility under your existing AmpolCard Framework terminates, these EV Charging Conditions will automatically terminate concurrently.
11. Limitation of Liability
11.1 Ampol will not, under any circumstances, be liable to you, whether directly or indirectly for:
(a) any fault with an EV Enabled Card or any unauthorised use, misuse or fraudulent use of an EV Enabled Card;
(b) power cuts, electricity shortages and grid failures, or any such similar circumstance;
(c) any faults with the electronic systems which operate the electric vehicle charging points across the AmpCharge Network and/or process EV Charging Transactions;
(d) any faults with or caused by a Cardholder’s Electric Vehicle, including but not limited to the Electric Vehicle’s battery or systems that enable the delivery of the EV Charging Product from the charging point into the battery, or any faults arising from a Cardholder’s failure to comply with vehicle or charging point manuals or instructions.
12. Use of Cards
12.1 Notwithstanding that EV Enabled Cards may be used to purchase EV Charging Products as well as other products that you are currently able to purchase using the AmpolCard Facility (such as petroleum products, lubricants and convenience store goods), EV Enabled Cards must be linked to an Electric Vehicle.
12.2 In order to commence an EV Charging Transaction, a Cardholder must tap the EV Enabled Card on the RFID reader at a charging point within the AmpCharge Network and follow the vehicle and charging point manuals and instructions.
12.3 You acknowledge and agree that:
(a) EV Charging Products are not eligible to earn Everyday Rewards Points; and
(b) FuelPay cannot be used to pay for EV Charging Products.
13. PINs and Identity Verification
13.1 A Cardholder must select and set a PIN for an EV Enabled Card in the Card Portal.
13.2 You are not required to enter your PIN for EV Charging Transactions. It is your responsibility to ensure the EV Enabled Cards are not misused or used by any person other than a Cardholder.
13.3 Where an EV Enabled Card is PIN activated, the PIN may be required for purchases of non-EV Charging Products (such as petroleum products, lubricants or convenience store products) as governed under your existing AmpolCard Framework.
14. Definitions and Interpretation
“AmpolCard Facility” means the facility to purchase products and services on credit using an AmpolCard as governed by your existing AmpolCard Framework;
“AmpolCard Framework” has the meaning given to it in clause 1.2;
“AmpCharge Network” means Ampol’s network of public electric vehicle charging points, participating locations of which can be found by using the Ampol site locator (available at ) and filtering for “EV Charging (AmpCharge)”;
“Cardholder” means a person who uses an EV Enabled Card with your authority;
“Card Portal” means the online customer portal which allows you to manage your AmpolCard account;
“Daily EV Charging Limit” has the meaning given to it in clause 7.1;
“Electric Vehicle” means an electric vehicle or plug-in hybrid electric vehicle;
“EV Charging Application” means an application by you to Ampol to add the EV Charging Product as a new product for purchase using the AmpolCard Facility;
“EV Charging Discount” has the meaning given to it in clause 6.1;
“EV Charging Product” means delivery of electricity measured in kWh using electric vehicle charging points on the AmpCharge Network to recharge Electric Vehicles;
“EV Charging Transaction” means a purchase transaction for which an EV Enabled Card is used by a Cardholder to purchase EV Charging Products;
“EV Enabled Card” means an AmpolCard which is enabled via RFID technology to use the AmpolCard Facility for the purchase of EV Charging Products.
